General Terms and Conditions

Please find our general terms and conditions below. We have different conditions for day visitors.

If you visit Attractie- en Vakantiepark Slagharen B.V. (AVS), you are agreeing to these terms and conditions. It is therefore important that you have read these conditions carefully before making the booking. AVS assumes that you have read the information provided on the website in addition to these general terms and conditions. The conditions for the park apply to all sites belonging to Attractie & Vakantiepark Slagharen. In cases where these park rules do not provide, the judgment of the park management applies.

1. Your booking and confirmation

1.1

The agreement is concluded when your request is accepted by AVS. Immediately after the conclusion of the agreement, AVS will provide you with written confirmation. Please check carefully whether all information is correct. If this is not the case, please contact AVS immediately so that any incorrect information can be changed for you. You can also make these changes digitally at: https://www.slagharen.com/en/account/login.

1.2

The agreement is concluded by you (as the main booker) for all participants. This means that the main booker (if not described separately) is responsible for the contract concluded by all participants.

1.3

All our accommodation packages include entrance to the theme park (rides, shows, Sunny Beach and entertainment) also on the day of arrival and departure, unless otherwise indicated. When staying at our resort, excluding the campsite, the use of our Aqua Mexicana water park is also included. If you have booked for the campsite, you do not have direct access to Aqua Mexicana. Holiday guests, with the exception of camping guests, have one free entry to the rope trail on presentation of their ticket and accommodation wristband. You can purchase separate entrance tickets either at the same time when you make your reservation or on site (based on availability).

1.4

Attractie- en Vakantiepark Slagharen B.V. (AVS) only accepts reservations by persons who are aged 18 or older. Reservations by persons under that age are therefore not valid.

1.5

Price discounts and/or special offers can no longer be used once the confirmation of the reservation has been sent by Attractie- en Vakantiepark Slagharen B.V. (AVS).

2. Additional costs

The following additional costs will be charged when booking:

2.1

Compulsory costs: The following costs are required with every booking

  • a. A charge for duvet cover sets (duvet cover, pillowcase and bottom sheet) of €7.95 pp (only for accommodation, not for camping pitches);
  • b. Municipal taxes per accommodation per night of €6.00. A rate per person per night applies to the campsite of €1.00;
  • c. Reservation costs per accommodation and/or camping pitch, as follows:

○     For accommodation booked by telephone €25.50 and booked via the internet €15.75;

○     For a camping pitch booked by telephone €25.50 and booked via the internet €15.75;

2.2

Optional costs: The following costs will be charged for a booking when the following options are used:

  • a. For booking various accommodation units next to each other or entering preferred numbers, an amount of €25.75 per booking is charged based on availability. For multiple preferred numbers, the preference costs per accommodation apply. Preference for a camping pitch is only possible by calling about this and is excluded for the high season.

3. Deposit

3.1

All damage caused by or because of you or your fellow users must be reported to the reception before departure and will be settled immediately. AVS will check the accommodation after your departure. Any costs will be recovered from you via the deposit.

4. Payments

4.1

When concluding the agreement, you must pay a deposit of 50% of the total costs within 8 days. You must make the remaining payment of 50% at least 14 days before the start of the stay. You can make your payment when booking through the service centre via iDEAL or bank transfer. For an online booking you can pay via iDEAL or credit card.

4.2

If a reservation is made within 30 days before arrival, the entire sum must be paid at once. Reservations within seven days before arrival can only be paid via iDEAL or credit card.

4.3

If you do not meet the payment conditions with regard to the down payment and/or remaining payment, then AVS reserves the right to terminate the agreement after a reminder with a notice of default. The cancellation costs as referred to in Article 6 will then be charged.

4.4

Payments within a week before arrival via a foreign bank transfer are not possible. This payment must be made upon check-in.

5. Changes

5.1

If you wish to communicate changes after confirming your booking, this is possible, provided that the changes do not have a significant influence on the general form of the trip. AVS is therefore free to determine whether these changes are accepted. The change costs amount to €18.50 per change.

5.2

If you want to change your travel date or accommodation within 30 days before arrival, the cancellation costs as set forth in Article 6 will be charged.

5.3

AVS reserves the right to charge for any price changes in the event of changing municipal taxes and/or VAT increase. If this price change is implemented, AVS will inform you about this in advance. No price changes will be made within 20 days prior to arrival.

6. Cancellation

6.1

You can cancel your booking in writing at any time before the start of the trip. Cancellation costs are calculated by AVS as follows:

  • Up to 60 days before arrival: 20%
  • Up to 30 days before arrival: 35%
  • Up to 15 days before arrival: 60%
  • Up to 8 days before arrival: 80%
  • Up to 3 days before arrival: 90%
  • Within 3 days before arrival: 100%

6.2

It is possible to take out cancellation insurance through AVS, which covers cancellation costs under certain circumstances. For more information about cancellation insurance and the conditions thereof, please contact AVS.

6.3

If you do not use your booking or one or more services within your booking without giving notice, the full price of your booking will remain valid.

6.4

AVS reserves the right to cancel an event and associated bookings up to 28 days prior to arrival if the specified minimum number of participants is not reached. In that case AVS will inform you of the cancellation as soon as possible and send you the required information. In that case you will be refunded the down payment you have already made.

7. Maximum capacity per type

7.1

The following maximum occupancy applies to the AVS accommodation units:

  • a. Cowboy Cottage, Hacienda, Wigwam Deluxe: max. two adults and four children;
  • b. Camping pitch: max. six people. A camping pitch is approximately 100 m2 and provides space for a maximum of one tent/caravan with a maximum of one extra tent;
  • c. Colorado: max. two adults and two children;
  • d. Yellowstone: max. four persons;
  • e. Missouri, Nevada, Nevada Deluxe and Raccoon Lodge: max. six persons

7.2

Only after explicit permission from AVS is it possible for one extra person (child) to stay in the Missouri, Nevada, Nevada Deluxe, Yellowstone, Hacienda, Cowboy Cottage and Raccoon Lodge accommodation units. In that case you must bring your own extra bed (e.g. mattress or air mattress). For an additional person, a surcharge of €45 applies for a midweek or weekend and €65 for a week. It is not permitted to book extra persons into the Colorado accommodation. In the Wigwam Deluxe accommodation one extra adult can be booked, provided the total number of persons in the accommodation does not exceed six.

7.3

Setting up tents at the accommodation units is not permitted.

8. Arrival and departure

8.1

It is possible to book a Lazy Sunday based on availability, so that you can use the accommodation until 6 p.m. on Sunday. You pay €19.95 per accommodation for this.

8.2

The opening times of the theme park are listed on the AVS website. Day guests must leave the park no later than two hours after the rides close.

8.3

The final cleaning of the accommodation is included in the charge. You must return the accommodation broom clean and in an orderly condition (do not leave dirty dishes, unload the dishwasher, strip the beds and place the linen by the door of the accommodation, clean the kitchen and fridge, put the rubbish bags into the rubbish containers). A cleaning kit is provided at the property upon arrival. You are obliged to treat the accommodation and the pertaining inventory with care.

9. Parking

9.1

Road traffic rules apply on the entire AVS site. The speed limit is 15 kilometres per hour.

9.2

Traffic indications given by AVS parking attendants prevail over traffic signs. To prevent traffic jams, the instructions of the parking attendant or signage must be followed at all times. If you do not follow the traffic rules and/or instructions properly, then AVS is entitled to remove your car at your own risk and expense.

9.3

Ensure that the car is properly locked and that no valuables are left in the car. AVS is not liable for any damage and/or theft relating to your vehicle.

9.4

The general car park is operated with barriers. You need an exit ticket to leave the car park. Day guests can purchase an exit ticket at the ticket machine located at the exit or at the theme park car park or at the Guest Service desk.

9.5

When you check in for your stay, you will receive a parking voucher, which you must place on the dashboard on the inside of the windscreen. At the Missouri, Yellowstone, Hacienda, Nevada, Nevada Deluxe, Cowboy Cottage and Raccoon Lodge accommodation units, one car can be parked next to the property free of charge. In addition, cars can be parked free of charge at the visitors’ car park. For the safety of our guests, car traffic in the park is not permitted between 11 p.m. and 7 a.m.

9.6

Bicycles, mopeds, scooters and motorbikes must be parked in or at the bicycle shed at the general car park.

9.7

Coaches must be parked in the coach park, as instructed by the parking attendant or signage.

9.8

Cars with caravans can be parked at Wigwamworld in the Raccoons car park on the day of arrival and departure. You must register to do this in advance at Reception.

9.9

The disabled car park is located in Section A of the parking area. This parking area may only be used if you hold a disabled car park ticket, which you must display visibly on the dashboard on the inside of the windscreen.

10. Pets

10.1

Only dogs are allowed in the theme park and in the Cowboy Cottage or Raccoon Lodge type accommodation units (with a maximum of one dog per accommodation) and on the campsite. A surcharge of €10.50 per night applies. Dogs must be kept on a lead at all times in the park and must wear a flea collar.

10.2

You can walk dogs at the designated dog-walking areas. If the dog relieves himself outside of this area, then AVS is entitled to charge a cleaning fee for this.

11. Inventory

11.1

An inventory list per accommodation is published on the AVS website.

12. Stay at the park

12.1

You enter the park at your own risk.

12.2

Access to the park is only possible with a valid admission ticket. The admission ticket is only valid on the day of issue or for the period for which it was issued. Upon leaving the park, the access right lapses. If as a guest you have to go outside the park during the day, you can get a stamp at the exit.

12.3

A wristband is used for guests who are staying. You must wear this wristband during your stay and show it when asked by a park employee. Failure to wear the wristband may result in no entry to or removal from the park.

12.4

House rules apply at the park. These house rules are listed on the house rule board at the entrance of the park, and concern the following rules:

  • dogs on a lead
  • no alcohol abuse
  • no spitting
  • no loud music
  • no drug possession and/or use
  • no bare upper bodies
  • aggressive behaviour will not be tolerated

12.5

No alcoholic beverages or tobacco are provided to persons under the age of 18. If there is any doubt about your age you must provide proof of identity.

12.6

It is forbidden to make an open fire, such as fire baskets, torches, garden fires, etc. You may not bring your own fireworks, lanterns, etc. and/or set them off. Smoking is not permitted in the buildings or on the rides. You must follow the fire regulations and indications.

12.7

The paths and roads of the park must be used. It is not permitted to stray from the paths.

12.8

It is forbidden to be in possession of or carry weapons or objects that can be dangerous during your visit to the park. The park employees are authorised to confiscate such weapons and objects the moment they are found. In the event of a reasonable suspicion of possession of weapons, the park employees are entitled to carry out a check.

12.9

Waste must be deposited in the relevant rubbish bins in the park. The waste is collected separately to preserve the environment.

12.10

Moving around the theme park in/with a (motorised) vehicle is not permitted.

12.11

For your and our safety, camera surveillance is used on the grounds and in the buildings of AVS. AVS reserves the right to transfer images to the competent authorities if it suspects a criminal offence. A registration will also be made with the “Overlast Donatie Winkeldiefstal” foundation. Committing theft or attempted theft may result in removal from the AVS site. AVS reserves the right to report this.

12.12

If there is misconduct towards other guests and/or park employees, then an AVS park employee can remove you or have you removed from the park.

12.13

Carrying proof of identification is mandatory. In connection with your and our safety, an AVS employee may ask you to show valid identification. AVS reserves the right, for security reasons or if the facts and/or circumstances reasonably so require, to conduct a preventive search, check bags and ask for a valid proof of identity. If you do not cooperate, this can lead to removal from the park.

12.14

The instructions of the park employees must be followed. The park employees are entitled to refuse persons who do not follow the instructions of park employees, challenge or break these park rules from using a ride or facility or remove them from the park without these persons being entitled to compensation.

12.15

For safety reasons, the use of selfie sticks and photo and/or film cameras on the rides and in the swimming pools and hot tubs is strictly prohibited.

12.16

The park is maintained as carefully as possible. However, it may occur that you encounter something less pleasant or that you have caused unintended damage. In that case, AVS kindly requests that you report this to the Guest Service desk.

12.17

Parents and guardians of children and groups are responsible for those visiting the park under their supervision. This means that parents and guardians are also liable for damage caused by those entrusted to them.

12.18

When visiting Aqua Mexicana, additional house rules apply which you will find at the entrance to Aqua Mexicana.

12.19

The use of drones is prohibited on all sites belonging to the Attractie & Vakantiepark Slagharen.

12.21

Visitors are not allowed to dress as security, police or military personnel.

13. Use of the rides and facilities

13.1

The use of rides and facilities is at your own risk. When using rides and other facilities, the instructions/rules of use indicated on the signs or given by the park staff must be followed.

13.2

You cannot claim compensation if rides and facilities are out of use in connection with maintenance, weather conditions or malfunctions.

13.3

The use of Black Hill Ranger Path is at your own risk. When using the Black Hill Ranger Path rides the following instructions/rules of use must be followed.

  • Respect the specified guidelines regarding age, height, weight and health.
  • Follow the guidelines and safety instructions indicated on the information boards and follow the guidelines of our park employees.
  • Keep hands, arms, legs and feet in the car of the ride at all times.
  • Make sure that all loose items such as wallets, change, glasses, mobile phones, cameras and scarves are properly put away.
  • Do not enter a closed or retired ride/playground device
  • Stay seated at all times when the ride is moving until you are instructed to leave the ride.
  • Always fasten the provided safety harness or belts, do not attempt to open them or squeeze out of them when the ride is in operation.
  • Parents/guardians are always responsible for the children they supervise.
  • If someone does not want to go on a ride, do not force the person to do so.
  • If you observe unsafe behaviour or situations during the ride, report this immediately to a park employee.

 

14. Complaints

14.1

If you are not satisfied with the services provided by AVS, you must report this to the AVS Guest Service department so that AVS has the opportunity to do something about it.

14.2

If your report has not been properly resolved, you must submit this in writing within and up to 14 days after your visit via guestservice@slagharen.com.

14.3

If you wish to prematurely terminate the agreement with AVS due to a failing, you must report this to the AVS Guest Service department before departure. A request for a refund of your payment can only be processed if you have notified AVS of your early termination in advance and if there is an unreasonable attitude on the part of AVS with regard to offering a suitable solution to your complaint.

15. Liability

15.1

AVS is only liable for personal injury and/or death if:

  • a. it is the result of intentional or negligent action and/or breach of duty by AVS or an AVS employee;
  • b. the damage has been reported to Guest Service during your visit to the park; and
  • c. your claim for compensation has been submitted to AVS within two years after the damage has been caused.

15.2

AVS accepts no liability for:

  • a. Damage that does not meet the conditions as stated in 15.1, loss, theft or damage to your personal belongings during or as a result of a visit or stay in the park.
  • b. The non-operation, deactivation or closure of rides and/or other facilities in the park.

15.3

In the event that AVS is unable, whether or not temporarily, to fulfil the agreement in whole or in part due to force majeure, AVS may submit an amended proposal within 14 days after it has become aware of the inability to fulfil the agreement.

16 Promotion

16.1

To promote AVS, AVS or parties commissioned by AVS can take photographs on the AVS site, in which you may appear. AVS reserves the right to use these photographs for promotional purposes, such as promotional campaigns and/or in brochures, etc. By entering the AVS site, you give your permission in advance for the use of any visual material on which you are visible.

16.2

Promoting or selling services and/or articles in the car park, in the vicinity and in the park, is not permitted without express written permission from AVS.

17 Applicable law and disputes

17.1

All agreements with AVS are governed by Dutch law.

17.2

In the event of a dispute between AVS and a visitor to the park, the court in the district of AVS’ registered office is authorised to hear the dispute.

17.3

The invalidity of any clause in these general terms and conditions does not affect the validity of all other clauses. If a clause in these general terms and conditions proves to be invalid, then the parties are deemed to have agreed on a valid replacement clause that approximates the invalid clause as far as possible in purport and scope.

The provisions for the park apply to all sites belonging to the Attractie & Vakantiepark Slagharen. In cases where these park rules do not provide, the judgment of the park management applies.
